OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
ELIGIBILITY: The Johnsonville Tailgate Throwdown (“Contest”) is open to legal residents of the contiguous United States and the District of Columbia (excluding residents of Colorado, Connecticut and Maryland), who are 21 years of age or older as of date of entry. The Contest is intended for viewing and participation in the United States only and shall be construed and evaluated only according to United States law. Do not proceed if you are not located in the contiguous United States at time of entry. Void in Alaska, Colorado, Connecticut, Hawaii, Maryland and where prohibited. Employees (and their immediate families (parents, child, spouses or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of Johnsonville, LLC (“Sponsor”), CMGRP, Inc., dba Current Marketing (“Administrator”), ESPN, Southeastern Conference, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter directly or on behalf of an individual . By participating, entrants agree to be bound by these Official Rules and the decisions of the judges and Sponsor, which are binding and final on matters relating to the Contest. The Contest is subject to all applicable federal, state, and local laws.
TO ENTER: Between 8:00 AM Eastern Time (“ET”) on October 17, 2019 and 11:59 PM ET on November 5, 2019 (the “Entry Period”), visit www.TailgateThrowdownContest.com and follow the directions to complete and submit the official entry form and include (i) the title of your original tailgate recipe that includes any type of Johnsonville sausage that can be prepped, assembled, cooked and plated in 30 minutes or less; (ii) a paragraph of seventy five (75) words or less describing your original tailgate recipe; (iii) a minimum of one (1) photos of the tailgate recipe you’re submitting; (iv) the name of one (1) SEC school you’re a fan of; (v) the full list of your original tailgate recipe ingredients, including the specific type of Johnsonville sausage used, and measurements of each; and (vi) recipe preparation and serving instructions (collectively, an “Entry”). No other method of entry will be accepted. Entries must be received by 11:59 PM ET on November 5, 2019 to be eligible.
Limit of one (1) Entry per person using only one (1) email address throughout the Entry Period. Entrants represent and warrant their Entry is the original work of such entrant, it has not been copied from others and it does not violate the rights of any other person or entity. Entries received from any person or household in excess of the stated limitation will be void. Entries with incomplete or erroneous information, Entries generated by script, macro or other automated or mechanical means and Entries made by any means which subvert the Entry process, are void. Entries may include but are not limited to tailgate recipes that could be served as an appetizer, main dish for breakfast, brunch or lunch/dinner, dessert, or beverage.
REQUIREMENTS OF ENTRIES: Entry may not contain, as determined by Sponsor, in its sole discretion, any recipe that:
· is defamatory, obscene, or otherwise unlawful, sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, or profane or pornographic;
· promotes illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);
· promotes any activities that may appear unsafe or dangerous;
· promotes any particular political agenda or message;
· is obscene or offensive, or endorses any form of hate or hate group;
· defames, misrepresents or contains disparaging remarks about other people, colleges or companies;
· contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) or other intellectual property owned by others (such as SEC school logos or references), without proper permission, or contains any personal identification, such as license plate numbers, street addresses, personal names or e-mail addresses;
· contains copyrighted materials owned by others (including recipe descriptions or ingredients, photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media);
· contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities, athletes or other public or private figures, living or dead, without proper permission;
· contains look-alikes of celebrities, athletes or other public or private figures, living or dead;
· communicates messages or images inconsistent with the positive images or good will of Sponsor;
· duplicates any other Entry in violation of these Official Rules or
· violates any law.
By participation – each entrant, and, by accepting a prize, the finalists and winners – covenants, warrants and represents that such entrant’s Entry is the original work of the entrant, has not been previously published, has not won previous awards, and does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If an Entry contains any material or elements that are not owned by the entrant, or which are subject to the rights of third parties, the entrant is disqualified. Sponsor reserves the right to request proof of these releases and consents in a form acceptable to Sponsor from any entrant at any time. Failure to provide such requested proof may, in Sponsor’s sole discretion, render the Entry null and void. By submitting an Entry, entrant covenants, warrants and represents that entrant and any persons identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use, exploitation and exhibition and any other action of Sponsor with respect to the Entry as set forth herein.
By submitting an Entry, each entrant hereby grants permission, and covenants, represents and warrants that such entrant has all releases and consents necessary to grant such permission, for the Entry to be posted on Sponsor’s and/or SEC Nation’s social and digital properties or other websites. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry and may remove a posted Entry at any time.
By submitting an Entry, each entrant acknowledges and agrees that (a) Sponsor may obtain many Entries in connection with the Contest or other contests staged or promoted by Sponsor, (b) such Entries may be similar or identical in theme, idea, format or other respects to other Entries submitted in connection with the Contest or entries for other contests sponsored by Sponsor or submitted for other reasons or other materials developed by or on behalf of Sponsor and (c) entrant waives any and all claims entrant may have had, may have, or may have in the future that any Entry or other works accepted, reviewed or used by Sponsor may be similar to entrant’s Entry, or that any compensation is due to entrant in connection with such Entry or other works used by Sponsor.
JUDGING TO DETERMINE FINALISTS: All Entries will be judged by a panel of qualified judges based on the following criteria: quality (30%), originality (30%), adherence to tailgating theme (20%), and visual representation (20%). The two (2) entries with the highest scores will be deemed potential Finalists, subject to verification and compliance with these Official Rules, and be invited to compete against each other at an onsite event, Saturday, December 7, 2019 prior to the SEC Championship game, at the Mercedes Benz Stadium in Atlanta, GA. A panel of judges at the onsite event will determine the one (1) ultimate recipe winner.
ON-SITE FINALIST EVENT: The two (2) Finalists will participate in a 30-minute timed cooking event Saturday, December 7, 2019 prior to the SEC Championship game, at the Mercedes Benz Stadium in Atlanta, GA. Each Finalist will have 30 minutes to prepare, assemble, cook and serve his/her recipe to the judges. Sponsor will provide all the necessary ingredients and cooking supplies including apparatus needed to cook/grill. Finalists will be instructed to provide an itemized list of what they need and the ingredients for the recipe in advance. Judges will use the criteria outlined above to determine the one (1) overall winner.
PUBLIC VOTE TO DETERMINE ULTIMATE FAN FAVORITE: All eligible recipe entries will be open for public voting at www.TailgateThrowdownContest.com (the “Website”) between November 6, 2019 at 8am ET and November 15, 2019 11:59 PM ET, when voting closes. During these dates, visitors can vote for their favorite tailgate recipe Entry to help determine the Ultimate Fan Favorite by visiting the Website and using the voting and social share buttons to choose their favorite submitted Tailgate Throwdown recipe Entry. Limit one (1) vote per email address per day. The (1) Entry with the highest number of eligible votes will be deemed the potential Ultimate Fan Favorite winner, and Sponsor will notify the Ultimate Fan Favorite via email.
Only votes submitted via the contest Website and a social share on Facebook and/or Twitter are eligible. Votes submitted via any other method, including but not limited to U.S. Postal Service, facsimile or other express delivery services, will NOT be accepted. When you vote via the Website, you can also opt-in to receive promotional offers and emails from Sponsor. You can opt-out of receiving such offers and emails at any time and opting-in does not impact your chances of winning. Votes received from any person or email address in excess of the stated daily limitation will be void. Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public and/or using any websites or online forums designed to induce individuals or provide other incentives to vote for their Entry, as determined by Sponsor in its sole discretion. All votes are subject to final verification by Sponsor. Use of script, macro or other automated system to vote or with the intent to impair the integrity of the voting process is prohibited and all such votes will be void.
ULTIMATE FAN FAVORITE AND FINALIST NOTIFICATION: The one (1) potential Ultimate Fan Favorite and two (2) Finalists will be notified by email and will be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Sponsor, which must be returned within two (2) days of date appearing on the winner notification. Return of notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact the potential winner within two (2) days of winner notification or noncompliance with these Official Rules by potential winner will result in disqualification and, at Sponsor’s sole discretion, a runner-up may be selected as an Ultimate Fan Favorite or Finalist.
PRIZES: One (1) Ultimate Fan Favorite Prize: A prize package consisting of the following elements: (i) Johnsonville Sausage for one (1) year (via 12 coupons for 2020 use, each redeemable for a Johnsonville Sausage product up to $5.00 in value) ; (ii) a Johnsonville Sizzling Sausage Grill; (iii) a Johnsonville official cornhole board set; (iv) a Johnsonville swag pack of merchandise. Approximate Retail Value (“ARV”): $450
Two (2) Finalist Prizes: A prize package consisting of the following elements will be awarded to each Finalist: (i) Two (2) tickets to the 2019 SEC Championship Game, scheduled to take place in Atlanta, GA on December 7, 2019; (ii) a two (2) night stay (one (1) room, double occupancy) at a hotel selected by Sponsor near the 2019 SEC Championship Game; (iii) a $1,000 general purpose gift card which may be used towards travel expenses and to defray potential taxes associated with the prize; and (iv) a Johnsonville swag pack of merchandise. ARV of each Finalist prize package: $2,100.
One (1) Winner from the December 7, 2019 onsite recipe contest will additionally be awarded (i) Johnsonville Sausage for one (1) year (via 12 coupons for 2020 use, each redeemable for a Johnsonville Sausage product up to $5.00 in value) and (ii) a Sizzling Sausage Grill ARV: $160.
PRIZE CONDITIONS: All prize details shall be determined in the sole and absolute discretion of Sponsor.
Finalists: Any transportation to/from the onsite event venue will not be provided by Sponsor and will be the Finalists’ sole responsibility. Finalists may not take only a portion of the prize and may not substitute, assign or transfer prize, but Sponsor reserves the right, at its sole discretion, to substitute prize with one of comparable or greater value. Finalists are solely responsible for all applicable federal, state, and local taxes. All costs and expenses associated with the prize acceptance and use not specified herein as being provided, including but not limited to travel, transportation costs, lodging or meal costs and services, in-room charges, meals, gratuities and other expenses incurred by accepting the Prize are the sole responsibility of the Finalists.
Exact make, model, size and color of swag merchandise to be determined by Sponsor, in its sole discretion. The total value of a coupon must be redeemed at one (1) transaction. Any unused balance will not be awarded. Coupons must be surrendered at time of redemption. Coupons are subject to certain terms and conditions specified by Sponsor. Coupons expire on date specified on each coupon. Coupons may not be used online or in conjunction with any other offer or discount. Valid only in the U.S.A. and are void where prohibited. Prize award is subject to verification of eligibility and compliance with these Official Rules. Released Parties will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of the SEC Championship Game. If the SEC Championship Game is delayed, postponed, or canceled for any reason whatsoever, Finalists will not be reimbursed or otherwise compensated for that portion of the Prize. Game tickets are awarded pursuant to a revocable, nontransferable license that is personal to the Finalists and may not be sold, resold, auctioned, bartered, assigned, exchanged, placed in commerce, transferred, given away, donated, or otherwise conveyed. A violation of these restrictions shall revoke Finalists license and may result in the Prize not being honored. Sponsor will not replace any lost, mutilated, or stolen tickets. The Finalists and their companions must abide by all venue policies and Game ticket terms and conditions. Sponsor reserves the right to revoke the Game tickets from Finalists or Finalists’ companions who Sponsor or venue personnel deem, in their sole discretion, may be intoxicated, be a safety risk, have violated any venue policy or law, or bring Sponsor or Released Parties into disrepute. Seat locations at the Game are subject to Sponsor’s sole discretion. Actual prize value is subject to fluctuations in the price of Game tickets not yet issued and winner will not receive the difference between actual and approximate retail value.
FINALIST FOOTAGE: Both Finalists may be photographed, videotaped and otherwise recorded by Sponsor during the onsite recipe competition and/or travel to the venue location (collectively, "Footage"). Footage will be owned by Sponsor who has the right to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names and likenesses embodied therein, on social media and in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, promotional, trade and other purposes. By accepting the prize, the Finalists agree that his/her name and likeness and those of any other individuals present may be included in the Footage, in Sponsor’s sole discretion. Both Finalists agree to help Sponsor retain necessary releases (as applicable) if requested by Sponsor to do so.
LICENSE/USE OF ENTRIES: By submitting an Entry, and to the extent allowed by law, you grant the Released Parties a perpetual, worldwide, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse your Entry, name, photo, recipes, and biographical material including, but not limited to, all materials submitted in connection with the Contest in any and all media, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to entrant or any third party.
GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, delayed, garbled or undelivered Entries, recipes, photos, or for network, server, Internet Service Provider (ISP), website, or other connections, computer, satellite, telephone or cable transmissions or lines, or computer hardware or software, or other equipment failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Entries, recipes or photos, the announcement of the prize or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in the Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by viruses, worms, bugs, non-authorized intervention or other causes which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, or in the event the Contest is unable to run as planned for any other reason, Sponsor reserves the right at its sole discretion to terminate the Contest and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect Entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor using the judging criteria specified above. Each entrant, by participating, and winner, by accepting the prize, agree that Sponsor, Administrator, ESPN, Southeastern Conference, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, shareholders, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and such entrant and winner will release, discharge, defend and hold Released Parties harmless from and against, any and all liabilities, injuries, losses or damages of any kind, including death to persons, or damage to property (collectively, “Losses”), resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize, or participation in the Contest, and for any and all Losses occurring at or during the onsite recipe competition (including, but not limited to, such Losses caused directly or indirectly by any vendors engaged by the Finalists to provide services or goods at or during the onsite recipe competition). Each entrant and Ultimate Fan Favorite and Finalists, except where legally prohibited, grants permission for Sponsor and its designees to use their name and address (city and state only) and an associated Entry, recipes, photo, voice and other likeness and prize information for programming, publicity, advertising, trade and promotional and other purposes without further compensation, in all media now known or hereafter discovered, worldwide and on the Internet and in perpetuity, without notice, inspection, review or approval and without restriction as to frequency of use or additional consents from entrant, winner or any third party. Entrant and winner agree to execute specific consents to enable Sponsor to pursue and protect its rights hereunder. Entrants, Ultimate Fan Favorite and Finalists also agree not to release any publicity or other materials on their own or through someone else regarding their participation in the Contest without the prior consent of Sponsor, which Sponsor may withhold in its sole discretion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
ARBITRATION: Except where prohibited by law, as a condition of participating in the Contest, each entrant agrees that (1) any and all disputes and causes of action arising out of or connected with the Contest, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in the Contest), and entrant further waives all rights to have damages multiplied or increased.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the internal substantive laws of the State of Wisconsin, USA.
REQUEST FOR THE ULTIMATE FAN FAVORITE AND FINALISTS NAMES: For the names of the Ultimate Fan Favorite and Finalists (available after January 1, 2020), send a self-addressed, stamped, envelope to: Johnsonville Tailgate Throwdown Contest, 875 North Michigan Avenue, Suite 2700, Chicago, IL 60657 for receipt no later than January 31, 2020.
